{"id":2060,"date":"2023-02-21T08:10:00","date_gmt":"2023-02-21T08:10:00","guid":{"rendered":"https:\/\/axislawconsulting.com\/?p=2060"},"modified":"2023-02-21T09:13:31","modified_gmt":"2023-02-21T09:13:31","slug":"kiralananin-yeniden-insasi-veya-imari-amaciyla-esasli-onarimi-nedeniyle-kiracinin-tahliyesi","status":"publish","type":"post","link":"https:\/\/axislawconsulting.com\/tr\/kiralananin-yeniden-insasi-veya-imari-amaciyla-esasli-onarimi-nedeniyle-kiracinin-tahliyesi\/","title":{"rendered":"Kiralanan\u0131n Yeniden \u0130n\u015fas\u0131 veya \u0130mar\u0131 Amac\u0131yla Esasl\u0131 Onar\u0131m\u0131 Nedeniyle Kirac\u0131n\u0131n Tahliyesi"},"content":{"rendered":"<p><strong>Kiralanan\u0131n Yeniden \u0130n\u015fas\u0131 veya \u0130mar\u0131 Amac\u0131yla Esasl\u0131 Onar\u0131m\u0131 Nedeniyle Kirac\u0131n\u0131n Tahliyesi<\/strong><\/p>\n<p>6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu 350\/2\u2019de kirac\u0131n\u0131n, kiralananda yap\u0131lacak yeniden in\u015fa veya kiralanan esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi sebebiyle tahliyesi d\u00fczenlenmi\u015ftir.<strong> Buna g\u00f6re kirac\u0131 kiralanan\u0131n y\u0131k\u0131l\u0131p yeniden in\u015fa edilmesi durumu mevcut olursa tahliye edebilecektir.<\/strong> Ayr\u0131ca kirac\u0131, kiralanan\u0131n imar\u0131 veya tadilat\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi gerekli olmas\u0131 ve bu i\u015fler s\u0131ras\u0131nda kullan\u0131m\u0131n\u0131n imk\u00e2ns\u0131z olmas\u0131 halinde tahliye edebilecektir. <u>Belirli s\u00fcreli kira s\u00f6zle\u015fmelerinde s\u00f6zle\u015fme s\u00fcresinin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde ise fesih d\u00f6nemi ve bildirim s\u00fcrelerine uyularak bir ay i\u00e7inde dava a\u00e7\u0131labilir.<\/u> A\u00e7\u0131lacak davada mahkeme, \u015fartlar\u0131n olup olmad\u0131\u011f\u0131n\u0131 de\u011ferlendirecek ve tahliyeye karar verecektir.<\/p>\n<p>Yeniden in\u015fa ve imar nedeniyle kirac\u0131n\u0131n tahliyesi, kanunda s\u0131n\u0131rl\u0131 say\u0131da d\u00fczenlenen kirac\u0131n\u0131n \u00f6zel tahliyesi sebeplerinden biridir. Bu tahliyesi sebebinde tahliyenin temelini in\u015faata ili\u015fkin teknik bilgilere olu\u015fturdu\u011fundan a\u00e7\u0131lacak davada bilirki\u015fi incelemesi ve ke\u015fif \u00f6nem kazanmaktad\u0131r. Zira bilirki\u015filer \u00f6ncelikle yeniden in\u015fa ve tadilat\u0131n gerekli olup olmad\u0131\u011f\u0131n\u0131 de\u011ferlendirecektir. Ayr\u0131ca bilirki\u015filer mahkemeye sunulan projenin yap\u0131lmas\u0131n\u0131n fen ve hukuk a\u00e7\u0131s\u0131ndan m\u00fcmk\u00fcn olup olmad\u0131\u011f\u0131n\u0131 de\u011ferlendirecektir.<\/p>\n<p><strong>1)Yeniden in\u015fa nedeniyle tahliyenin kanuni d\u00fczenlemesi:<\/strong><\/p>\n<p><strong>TBK 350\/2: <\/strong>Kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi gerekli ve bu i\u015fler s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131 imk\u00e2ns\u0131z ise, belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir.<\/p>\n<p>6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu (TBK) m. 350\/2\u2019de ta\u015f\u0131nmazda kirac\u0131 varken kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m, geni\u015fletilmesi veya de\u011fi\u015ftirilmesi m\u00fcmk\u00fcn olmad\u0131\u011f\u0131ndan kiraya verenin kirac\u0131s\u0131n\u0131 tahliye edebilece\u011fi d\u00fczenlenmi\u015ftir. Burada kirac\u0131n\u0131n tahliye edilmesinin sebebi kirac\u0131 varken yap\u0131lacak tadilat\u0131n ve yeniden in\u015fan\u0131n m\u00fcmk\u00fcn olmamas\u0131d\u0131r.<\/p>\n<p><strong>2)Yeniden \u0130n\u015fa Nedeniyle Tahliyenin \u015eartlar\u0131: <\/strong><\/p>\n<p>Kiraya verenin TBK 350\/2\u2019ye dayal\u0131 olarak kirac\u0131y\u0131 tahliye edebilmesi i\u00e7in birtak\u0131m \u015fartlar\u0131n mevcut olmas\u0131 gerekmektedir. <u>Bu \u015fartlar, kiralanan\u0131n y\u0131k\u0131l\u0131p ba\u015ftan yap\u0131lmas\u0131 veya tadilat\u0131, tadilat\u0131n esasl\u0131 olmas\u0131, kiralanan\u0131n kullan\u0131m\u0131n\u0131n imkans\u0131z olmas\u0131, yeniden in\u015fa ve tadilata ili\u015fkin onayl\u0131 projenin olmas\u0131 ve davan\u0131n s\u00fcresi i\u00e7inde a\u00e7\u0131lmas\u0131d\u0131r. <\/u><\/p>\n<p><strong>2.1) Kiralanan\u0131n Y\u0131k\u0131l\u0131p Yeniden \u0130n\u015fas\u0131:<\/strong> TBK 350\/2\u2019de d\u00fczenlenen ilk tahliye sebebi yeniden in\u015fad\u0131r. Kanundaki in\u015fa ifadesinden binay\u0131 y\u0131k\u0131p yerinde yeni bir bina in\u015fa etmek anla\u015f\u0131lmal\u0131d\u0131r. Di\u011fer bir anlat\u0131mla yeniden in\u015fa durumunda sadece eski binan\u0131n y\u0131k\u0131l\u0131p yerine yeni bir in\u015fa edilmesi yeterlidir. Binan\u0131n y\u0131k\u0131lmas\u0131 halinde zaten kirac\u0131 ta\u015f\u0131nmaz\u0131 kullanamayaca\u011f\u0131 i\u00e7in bu \u015fart aranmaz.<\/p>\n<p><strong>2.2) \u0130mar Ama\u00e7l\u0131 Esasl\u0131 Onar\u0131m, Geni\u015fletilme ve De\u011fi\u015ftirme Yap\u0131lmas\u0131: <\/strong>TBK 350\/ b.2\u2019de d\u00fczenlenen ikinci tahliye sebebi ise kiralanan\u0131n esasl\u0131 onar\u0131, geni\u015fletme ve de\u011fi\u015ftirme sebebiyle imar ama\u00e7l\u0131 tadilatt\u0131r. <u>Yap\u0131lacak tadilat ve imarda amac\u0131n kiralanan\u0131n daha iyi duruma getirilmesi, harap durumdan kurtar\u0131lmas\u0131, daha kullan\u0131l\u0131r hale getirilmi\u015f olmas\u0131d\u0131r.<\/u> Aksi halde a\u00e7\u0131lacak tahliye davas\u0131 reddedilecektir. \u00d6rne\u011fin kiralanandan daha fazla gelir etmek amac\u0131yla d\u00fckkana \u00e7evrilmesi amac\u0131n\u0131 ta\u015f\u0131yan imar ve tadilat tahliye gerek\u00e7esi yap\u0131lamaz. Esasl\u0131 onar\u0131m, geni\u015fletme ve de\u011fi\u015ftirme birbirinden farkl\u0131 tahliye gerek\u00e7eleri olup;<\/p>\n<ul>\n<li>Esasl\u0131 onar\u0131m, kiralanan\u0131n, zaman\u0131n veya d\u0131\u015far\u0131dan ba\u015fka bir etki sebebiyle hasara u\u011framas\u0131 veya eskimesi sebebiyle iyile\u015ftirilmesidir. Do\u011fal afet sebebiyle zay\u0131flayan binan\u0131n kolanlar\u0131n\u0131n g\u00fc\u00e7lendirilmesi esasl\u0131 onar\u0131ma \u00f6rnek verilebilir.<\/li>\n<li>Kiralanan\u0131n geni\u015fletilmesi ise kiralanana yeni oda, balkon, yeni kat ekleyerek veya bina i\u00e7indeki i\u015f ve d\u0131\u015f duvarlar\u0131n yeri de\u011fi\u015ftirilerek binan\u0131n kullan\u0131m alan\u0131n\u0131n art\u0131r\u0131lmas\u0131d\u0131r.<\/li>\n<li>De\u011fi\u015ftirme ise binan\u0131n kullan\u0131m \u015feklinde veya kolayla\u015ft\u0131racak \u015fekilde yap\u0131lacak tadilatlar\u0131d\u0131r. \u00d6rne\u011fin iki dairenin birle\u015ftirilmesi, asans\u00f6r yap\u0131lmas\u0131, petek tak\u0131lmas\u0131.<\/li>\n<\/ul>\n<p><strong>NOT:<\/strong> Kiraya veren tahliye davas\u0131 a\u00e7t\u0131\u011f\u0131nda esasl\u0131 onar\u0131m, geni\u015fletme ve de\u011fi\u015ftirme nedenlerinden hangisine dayand\u0131\u011f\u0131n\u0131 belirtmelidir. Yeniden in\u015fadan farkl\u0131 olarak yap\u0131lacak imar ve tadilat\u0131n esasl\u0131 olmas\u0131 gerekmektedir. Onar\u0131m, geni\u015fletme ve de\u011fi\u015ftirmenin esasl\u0131 olmas\u0131, ta\u015f\u0131nmazsa in\u015faat projesini gerektirecek \u015fekilde i\u015f yap\u0131lmas\u0131d\u0131r. Basit tamir i\u015fleri esasl\u0131 tadilat olarak kabul edilemez. Yap\u0131lacak tadilat\u0131n esasl\u0131 olup olmad\u0131\u011f\u0131n\u0131n tespiti bilirki\u015filer ac\u0131l\u0131\u011f\u0131yla yap\u0131l\u0131r.<\/p>\n<p><strong>2.3) Yap\u0131lacak Yeniden \u0130n\u015fa Nedeniyle Kiralanan\u0131n Kullan\u0131m\u0131n\u0131n \u0130mkans\u0131z Olmas\u0131:<\/strong> TBK 350\/2\u2019de yer alan \u2018\u2019bu i\u015fler s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131 imkans\u0131z ise\u2019\u2019 ifadesinden a\u00e7\u0131k\u00e7a kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131 imkans\u0131z olmas\u0131 halinde kirac\u0131n\u0131n tahliye edebilece\u011fi d\u00fczenlenmi\u015ftir. Di\u011fer bir anlat\u0131mla in\u015faat i\u015flerinin kiralananda oturulmas\u0131na veya i\u015fyeri ise kiralanan\u0131n kullan\u0131lmas\u0131na engel olmas\u0131 gerekmektedir. Yeniden in\u015fada kiralanan y\u0131k\u0131laca\u011f\u0131ndan i\u00e7inde oturmak zaten m\u00fcmk\u00fcn olmayacakt\u0131r. Kiralanan\u0131n kullan\u0131m\u0131n\u0131n m\u00fcmk\u00fcn olup olmad\u0131\u011f\u0131 yine bilirki\u015filerce tespit edilecektir. E\u011fer kiralanan\u0131n imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi s\u0131ras\u0131nda, ta\u015f\u0131nmaz\u0131n kullan\u0131lmas\u0131 m\u00fcmk\u00fcn ise tahliye davas\u0131 reddedilecektir.<\/p>\n<p><strong>2.4) Yeniden \u0130n\u015faya \u0130li\u015fkin Projenin Mahkemeye Sunulmu\u015f Olmas\u0131:<\/strong> Kanunda yap\u0131lacak yeniden in\u015fa ve esasl\u0131 tamirata ili\u015fkin onayl\u0131 projenin mahkemeye sunulmas\u0131na ili\u015fkin bir d\u00fczenleme yoktur. Ancak Yerle\u015fik Yarg\u0131tay uygulamas\u0131nda onayl\u0131 in\u015faat projesinin olmas\u0131 davan\u0131n kabul\u00fc i\u00e7in \u015fartt\u0131r. \u0130n\u015faat projesinin belediyeden onaylanmas\u0131 \u015fartt\u0131r. Ayr\u0131ca mahkeme bilirki\u015filerce onayl\u0131 projenin fiilen ve hukuken uygulan\u0131p uygulanamayaca\u011f\u0131n\u0131 tespit ettirecektir. Yeniden in\u015fa nedeniyle a\u00e7\u0131lan tahliye davas\u0131nda, dava dilek\u00e7esi ile birlikte in\u015faat ruhsat\u0131n\u0131n ibraz edilmesine gerek yoktur. Zira bina y\u0131k\u0131lmaks\u0131z\u0131n yeni yap\u0131lacak bina i\u00e7in ruhsat verilmesi m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p><strong>Yarg\u0131tay 3. Hukuk Dairesi Esas: 2017\/16718 Karar: 2018\/4453 Karar Tarihi: 25.04.2018<\/strong><\/p>\n<p>\u2018T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 350\/2. maddesi h\u00fckm\u00fc uyar\u0131nca kiralanan\u0131n yeniden in\u015fa veya imar amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi nedeniyle a\u00e7\u0131lacak tahliye davalar\u0131nda, imarca tasdikli mimari ya da avan projenin ibraz\u0131 zorunludur. Ne var ki s\u00f6z konusu projenin davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 s\u0131rada verilmesi \u015fart olmay\u0131p dava tarihinden sonra da ibraz\u0131 m\u00fcmk\u00fcnd\u00fcr. Somut olayda, davac\u0131 vekili, projenin uygulanaca\u011f\u0131 alan\u0131n \u00e7ok geni\u015f bir saha oldu\u011funu, birden \u00e7ok ta\u015f\u0131nmaz mevcut olup tevhid i\u015flemlerinin ger\u00e7ekle\u015ftirilece\u011fini, bu nedenle projenin onay a\u015famas\u0131na gelmedi\u011fini beyanla s\u00fcre verilmesini talep etmi\u015ftir. Mahkemece, projenin dava a\u00e7\u0131ld\u0131\u011f\u0131 s\u0131rada haz\u0131r olmas\u0131 gerekti\u011fi gerek\u00e7esiyle davan\u0131n reddine karar verilmi\u015f ise de projenin dava tarihinden sonra yarg\u0131lama s\u0131ras\u0131nda ibraz\u0131 m\u00fcmk\u00fcn oldu\u011funa g\u00f6re Mahkemece ilgili tarafa proje ibraz\u0131 i\u00e7in usul\u00fcne uygun \u015fekilde kesin s\u00fcre verilerek sonucuna g\u00f6re deliller de\u011ferlendirilip bir karar verilmesi gerekirken, eksik ara\u015ft\u0131rma ile yaz\u0131l\u0131 \u015fekilde istemin reddine karar verilmesinin hatal\u0131 oldu\u011fu bu defaki incelemeden anla\u015f\u0131lmakla davac\u0131n\u0131n karar d\u00fczeltme iste\u011finin kabul\u00fc ile Dairemizin 20.09.2017 g\u00fcn ve 2017\/3975 Esas- 2017\/12373 Karar say\u0131l\u0131 ilam\u0131n\u0131n kald\u0131r\u0131larak h\u00fckm\u00fcn bozulmas\u0131na karar verilmesi gerekmi\u015ftir.\u2019<\/p>\n<p><strong>2.5) Yeniden \u0130n\u015fa ve \u0130mar Nedeniyle Tahliye Davas\u0131nda S\u00fcre:<\/strong> Yeniden in\u015fa ve imar nedeniyle tahliye davas\u0131 a\u00e7\u0131lmas\u0131 i\u00e7in kiraya verenin bu konu hakk\u0131nda ihtarda veya bildirimde bulunmas\u0131 gerekli de\u011fildir. TBK 350\/2\u2019ye g\u00f6re, kira s\u00f6zle\u015fmesi belirli s\u00fcreli ise, davac\u0131, bu s\u00fcrenin sona ermesinden itibaren bir ayl\u0131k s\u00fcre i\u00e7erisinde, kira s\u00f6zle\u015fmesi belirsiz s\u00fcreli ise, fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyarak belirlenecek tarihten itibaren bir ay i\u00e7erisinde tahliye davas\u0131n\u0131 a\u00e7mal\u0131d\u0131r. \u00d6ng\u00f6r\u00fclen bir ayl\u0131k s\u00fcre hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcre olup mahkemece re\u2019sen dikkate al\u0131nacakt\u0131r.<\/p>\n<p><strong>3)Yeniden \u0130n\u015fa Nedeniyle Tahliyeden Sonra Ta\u015f\u0131nmaz\u0131 \u00dc\u00e7\u00fcnc\u00fc Ki\u015fiye Kiralama Yasa\u011f\u0131: <\/strong>TBK 355\/2\u2019ye g\u00f6re;<\/p>\n<ul>\n<li>Kiraya veren, gereksinim amac\u0131yla kiralanan\u0131n bo\u015falt\u0131lmas\u0131n\u0131 sa\u011flad\u0131\u011f\u0131nda, hakl\u0131 sebep olmaks\u0131z\u0131n, kiralanan\u0131 \u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e eski kirac\u0131s\u0131ndan ba\u015fkas\u0131na kiralayamaz. \u25cfYeniden in\u015fa ve imar amac\u0131yla bo\u015falt\u0131lmas\u0131 sa\u011flanan ta\u015f\u0131nmazlar, eski h\u00e2li ile, hakl\u0131 sebep olmaks\u0131z\u0131n \u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e ba\u015fkas\u0131na kiralanamaz. Eski kirac\u0131n\u0131n, yeniden in\u015fa ve imar\u0131 ger\u00e7ekle\u015ftirilen ta\u015f\u0131nmazlar\u0131, yeni durumu ve yeni kira bedeli ile kiralama konusunda \u00f6ncelik hakk\u0131 vard\u0131r. Bu hakk\u0131n, kiraya verenin yapaca\u011f\u0131 yaz\u0131l\u0131 bildirimi izleyen bir ay i\u00e7inde kullan\u0131lmas\u0131 gerekir; bu \u00f6ncelik hakk\u0131 sona erdirilmedik\u00e7e, ta\u015f\u0131nmaz \u00fc\u00e7 y\u0131l ge\u00e7meden ba\u015fkas\u0131na kiralanamaz. Kiraya veren, bu h\u00fck\u00fcmlere ayk\u0131r\u0131 davrand\u0131\u011f\u0131 takdirde, eski kirac\u0131s\u0131na son kira y\u0131l\u0131nda \u00f6denmi\u015f olan bir y\u0131ll\u0131k kira bedelinden az olmamak \u00fczere tazminat \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/li>\n<\/ul>\n<p>Kiraya veren, bu h\u00fck\u00fcmlere ayk\u0131r\u0131 davrand\u0131\u011f\u0131 takdirde, eski kirac\u0131s\u0131na son kira y\u0131l\u0131nda \u00f6demi\u015f olan bir y\u0131ll\u0131k kira bedelinden az olmamak \u00fczere tazminat \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr. Ancak kiraya verenin bu bedelden sorumlu olmas\u0131 i\u00e7in kirac\u0131n\u0131n dava yoluyla tahliye edilmesi gerekmektedir. Kirac\u0131 kendi iste\u011fi veya kiraya verenin dava d\u0131\u015f\u0131ndaki talebi neticesinde kiralanan\u0131n tahliye etmi\u015fse tazminat talep edemez.<\/p>\n<p><strong>Yarg\u0131tay 3. Hukuk Dairesi Esas 2017\/4632 Karar: 2019\/ 1687 Karar Tarihi: 28.02.2019 <\/strong><\/p>\n<p><u>\u2018\u2026Daval\u0131lar gereksinim, yeniden in\u015fa ve imar amac\u0131yla bir tahliye davas\u0131 a\u00e7mam\u0131\u015ft\u0131r. Davac\u0131 kirac\u0131 ta\u015f\u0131nmaz\u0131 bir yarg\u0131 karar\u0131 veya icra marifetiyle tahliye etmemi\u015ftir. Bu durumda 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 355. maddesi uyar\u0131nca tazminat ko\u015fullar\u0131 olu\u015fmam\u0131\u015ft\u0131r.<\/u> Bu durumda mahkemece davan\u0131n bu gerek\u00e7e ile reddine karar verilmesi gerekirken, yaz\u0131l\u0131 gerek\u00e7e ile davan\u0131n reddine karar verilmesinin do\u011fru olmad\u0131\u011f\u0131 anla\u015f\u0131lm\u0131\u015ft\u0131r.\u2019<\/p>\n<p><strong>4)Yeniden \u0130n\u015fa Nedeniyle Tahliye Davas\u0131nda Zamana\u015f\u0131m\u0131 ve Hak D\u00fc\u015f\u00fcr\u00fcc\u00fc S\u00fcre:<\/strong><\/p>\n<p>Kira s\u00f6zle\u015fmesi belirli s\u00fcreli olarak kararla\u015ft\u0131r\u0131lm\u0131\u015fsa kiraya veren ancak kira s\u00f6zle\u015fmesinin s\u00fcresinin bitiminden itibaren 1 ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile kirac\u0131n\u0131n tahliyesini isteyebilir.
