bu miktar\u0131 a\u015far \u015fekilde belirlenen kira bedelinde art\u0131\u015f yap\u0131lmas\u0131 durumunda kirac\u0131 mahkemeye ba\u015fvurarak kira bedelinin tespitini isteyebilmektedir.<\/p>\n<p>Ancak 7409 say\u0131l\u0131 kanunla 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019na eklenen madde gere\u011fiyle 10.06.2022 ile 01.07.2023 tarihleri aras\u0131nda yenilenen konut kiras\u0131 s\u00f6zle\u015fmelerinde art\u0131\u015f oran\u0131 %25 olarak belirlenmi\u015ftir ve bu oran\u0131 a\u015famayacakt\u0131r; dolay\u0131s\u0131yla bu oran\u0131 a\u015fmadan kararla\u015ft\u0131r\u0131lan kira art\u0131\u015f bedellerinden \u00f6t\u00fcr\u00fc kira tespit davas\u0131 a\u00e7\u0131lamayacakt\u0131r.<\/p>\n<ul>\n<li><strong>DEVAM EDEN EN AZ 5 YILLIK K\u0130RA \u0130L\u0130\u015eK\u0130S\u0130 OLMASI<\/strong><\/li>\n<\/ul>\n<p>G\u00fcn\u00fcm\u00fcz ekonomik ko\u015fullar\u0131nda ger\u00e7ekle\u015fen y\u00fcksek enflasyon vb. sebeplerden \u00f6t\u00fcr\u00fc paran\u0131n de\u011fer kayb\u0131 da g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda kanuni d\u00fczenleme sonucu getirilmi\u015f olan %25 art\u0131\u015f oran\u0131 uzun s\u00fcre s\u00fcrm\u00fc\u015f olan kira s\u00f6zle\u015fmeleri bak\u0131m\u0131n yeterli kalmayabilmektedir.<\/p>\n<p>Mahkeme bu gibi durumlarda ta\u015f\u0131nmaz\u0131n durumu, emsal ta\u015f\u0131nmaz kiralar\u0131 ve \u00dcFE art\u0131\u015f oran\u0131 gibi \u00f6zellikleri de dikkate alarak kira art\u0131\u015f oran\u0131 belirleyecektir.<\/p>\n<p>Kira s\u00f6zle\u015fmesinin 5 y\u0131ldan fazla devam etti\u011fi durumlarda mahkeme y\u0131ll\u0131k art\u0131\u015f oran\u0131 ile ba\u011fl\u0131 de\u011fildir, gerekli incelemeleri ilgili ki\u015fi ve kurumlara yapt\u0131rd\u0131ktan sonra kira bedelindeki art\u0131\u015f\u0131 hakkaniyete g\u00f6re belirleyecektir.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>T\u00dcRK BOR\u00c7LAR KANUNU 344\/3<\/strong><\/p>\n<p>Taraflarca bu konuda bir anla\u015fma yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n, be\u015f y\u0131ldan uzun s\u00fcreli veya be\u015f y\u0131ldan sonra yenilenen kira s\u00f6zle\u015fmelerinde ve bundan sonraki her be\u015f y\u0131l\u0131n sonunda, yeni kira y\u0131l\u0131nda uygulanacak kira bedeli, h\u00e2kim taraf\u0131ndan \u00fcretici fiyat endeksindeki art\u0131\u015f oran\u0131, kiralanan\u0131n durumu ve emsal kira bedelleri g\u00f6z \u00f6n\u00fcnde tutularak hakkaniyete uygun bi\u00e7imde belirlenir. Her be\u015f y\u0131ldan sonraki kira y\u0131l\u0131nda bu bi\u00e7imde belirlenen kira bedeli, \u00f6nceki f\u0131kralarda yer alan ilkelere g\u00f6re de\u011fi\u015ftirilebilir.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>T\u00dcRK BOR\u00c7LAR KANUNU MADDE 344\/4<\/strong><\/p>\n<p>S\u00f6zle\u015fmede kira bedeli yabanc\u0131 para olarak kararla\u015ft\u0131r\u0131lm\u0131\u015fsa, be\u015f y\u0131l ge\u00e7medik\u00e7e kira bedelinde de\u011fi\u015fiklik yap\u0131lamaz. Ancak, bu Kanunun, \u201cA\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc\u201d ba\u015fl\u0131kl\u0131 138 inci maddesi h\u00fckm\u00fc sakl\u0131d\u0131r. Be\u015f y\u0131l ge\u00e7tikten sonra kira bedelinin belirlenmesinde, yabanc\u0131 paran\u0131n de\u011ferindeki de\u011fi\u015fiklikler de g\u00f6z \u00f6n\u00fcnde tutularak \u00fc\u00e7\u00fcnc\u00fc f\u0131kra h\u00fckm\u00fc uygulan\u0131r.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>K\u0130RA TESP\u0130T DAVASINI K\u0130MLER A\u00c7AB\u0130L\u0130R?<\/strong><\/p>\n<p>Kira tespit davas\u0131n\u0131 kirac\u0131, kiraya veren ve malik a\u00e7abilmektedir.<\/p>\n<p>Ancak uygulamada ortaya \u00e7\u0131kan birden \u00e7ok kiraya verenin veyahut kirac\u0131n\u0131n bulunmas\u0131 gibi birtak\u0131m durumlar kar\u0131\u015f\u0131kl\u0131k yaratabilmektedir. Bu noktada her olay\u0131 kendi i\u00e7erisinde de\u011ferlendirmek daha faydal\u0131 ve sa\u011fl\u0131kl\u0131 olacakt\u0131r.<\/p>\n<p>Birden \u00e7ok kiraya verenin bulundu\u011fu durumlarda kira tespit davas\u0131n\u0131 kiraya verenlerin durumu zorunlu dava arkada\u015fl\u0131\u011f\u0131 te\u015fkil etti\u011finden dolay\u0131 davay\u0131 birlikte a\u00e7malar\u0131 gerekmektedir.<\/p>\n<p>Birden \u00e7ok malikin bulundu\u011fu ve payl\u0131 m\u00fclkiyet ortakl\u0131\u011f\u0131 bulundu\u011fu durumlarda ise ihtiyar\u0131 dava arkada\u015fl\u0131\u011f\u0131ndan s\u00f6z edilece\u011finde malikler birbirlerinden ba\u011f\u0131ms\u0131z \u015fekilde kendi paylar\u0131 bak\u0131m\u0131ndan kira tespit davas\u0131 a\u00e7abileceklerdir.<\/p>\n<p>Bir di\u011fer ihtimal ise kirac\u0131lar\u0131n birden fazla olmas\u0131 durumudur kira bedeli b\u00f6l\u00fcnemez oldu\u011fundan dolay\u0131 kirac\u0131lar kira tespit davas\u0131n\u0131 birlikte a\u00e7malar\u0131 gerekmektedir.<\/p>\n<p>Son olarak belirtmek gerekir ki kira s\u00f6zle\u015fmelerinin taraflar\u0131ndan herhangi birisi \u00f6lm\u00fc\u015f ise bu davay\u0131 yasal miras\u00e7\u0131lar\u0131 da a\u00e7abilmektedir.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>K\u0130RA TESP\u0130T DAVASI K\u0130ME KAR\u015eI A\u00c7ILAB\u0130L\u0130R?<\/strong><\/p>\n<p>Kira s\u00f6zle\u015fmesinin kar\u015f\u0131 taraf\u0131n\u0131 kim veya kimler te\u015fkil ediyorsa kira tespit davas\u0131 ona kar\u015f\u0131 a\u00e7\u0131lmal\u0131d\u0131r.<\/p>\n<p>Birden fazla kirac\u0131n\u0131n bulundu\u011fu durumlarda ihtar\u0131n t\u00fcm kirac\u0131lara kar\u015f\u0131 yap\u0131lmas\u0131 gerekmektedir.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><strong>K\u0130RA TESP\u0130T DAVALARINDA DAVA A\u00c7MA S\u00dcRES\u0130:<\/strong><\/p>\n<p>Kira s\u00f6zle\u015fmesi devam etti\u011fi s\u00fcrece gerekli \u015fartlar mevcutsa her zaman kira tespit davas\u0131 a\u00e7\u0131labilir.<\/p>\n<p>Ancak kira tespit davas\u0131n\u0131n ne zaman a\u00e7\u0131ld\u0131\u011f\u0131 uygulanaca\u011f\u0131 kira d\u00f6nemi bak\u0131m\u0131ndan \u00f6nem ta\u015f\u0131maktad\u0131r belirlenecek ve artacak olan kira bedelinin bir sonraki kira d\u00f6nemi uygulanabilmesi i\u00e7in;<\/p>\n<ol>\n<li>Davan\u0131n yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan en az 30 g\u00fcn \u00f6nce a\u00e7\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/li>\n<li>Kiraya veren taraf\u0131ndan yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan en az 30 g\u00fcn \u00f6nce kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin olarak kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunulmu\u015f olmas\u0131 ko\u015fuluyla davan\u0131n yeni kira d\u00f6neminde a\u00e7\u0131lmas\u0131 da m\u00fcmk\u00fcnd\u00fcr.<\/li>\n<li>S\u00f6zle\u015fmede yeni kira d\u00f6neminde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin bir h\u00fck\u00fcm varsa yeni kira d\u00f6neminin sonuna kadar a\u00e7\u0131lacak davada mahkemece belirlenecek kira bedeli de, bu yeni d\u00f6nemin ba\u015flang\u0131c\u0131ndan itibaren ge\u00e7erli olur.<\/li>\n<\/ol>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>T\u00dcRK BOR\u00c7LAR KANUNU MADDE 345-<\/strong> Kira bedelinin belirlenmesine ili\u015fkin dava her zaman a\u00e7\u0131labilir. Ancak, bu dava, yeni d\u00f6nemin ba\u015flang\u0131c\u0131ndan en ge\u00e7 otuz g\u00fcn \u00f6nceki bir tarihte a\u00e7\u0131ld\u0131\u011f\u0131 ya da kiraya veren taraf\u0131ndan bu s\u00fcre i\u00e7inde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin olarak kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunulmu\u015f olmas\u0131 ko\u015fuluyla, izleyen yeni kira d\u00f6nemi sonuna kadar a\u00e7\u0131ld\u0131\u011f\u0131 takdirde, mahkemece belirlenecek kira bedeli, bu yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan itibaren kirac\u0131y\u0131 ba\u011flar.
