Zemin katta oturan kat malikleri asans\u00f6r\u00fc kullanmad\u0131klar\u0131 i\u00e7in asans\u00f6r bak\u0131m masraflar\u0131na \u00e7o\u011fu zaman kat\u0131lmak istememektedir.<br data-start=\"755\" data-end=\"758\" \/>G\u00fcn\u00fcm\u00fczde bir\u00e7ok ki\u015fi hukuki konular hakk\u0131nda bilgi edinmek i\u00e7in internet \u00fczerindeki \u00e7e\u015fitli platformlardan yararlanmakta ve farkl\u0131 kaynaklara ula\u015fmaktad\u0131r. \u00d6rne\u011fin, \u00e7e\u015fitli \u00e7evrimi\u00e7i platformlara <a href=\"https:\/\/axislawconsulting.com\/ru\/team\/\"><span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">MIMISLOT<\/span><\/span> <\/a>\u00fczerinden eri\u015fim sa\u011flayan kullan\u0131c\u0131lar da benzer \u015fekilde farkl\u0131 konular hakk\u0131nda bilgi aray\u0131\u015f\u0131 i\u00e7inde olabilmektedir.<\/p>\n<p>Halbuki; Kat M\u00fclkiyeti Kanunu\u2019nun 20. maddesine g\u00f6re <strong><em>\u201cKat malikleri ortak yer veya tesisler \u00fczerindeki kullanma hakk\u0131ndan vazge\u00e7mek veya kendi ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00fcn durumu dolay\u0131s\u0131yla bunlardan faydalanmaya l\u00fczum ve ihtiya\u00e7 bulunmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrmek suretiyle bu gider ve avans pay\u0131n\u0131 \u00f6demekten ka\u00e7\u0131namaz.\u201d <\/em><\/strong><em>\u00a0\u00a0<\/em>h\u00fckm\u00fc gere\u011fince apartman aidatlar\u0131ndan kirac\u0131 ile kat maliki m\u00fc\u015ftereken ve m\u00fcteselsilen sorumludur. Ancak kirac\u0131n\u0131n sorumlulu\u011fu \u00f6demekle y\u00fck\u00fcml\u00fc oldu\u011fu kira miktar\u0131 ile s\u0131n\u0131rl\u0131 olup yapt\u0131\u011f\u0131 \u00f6deme kira borcundan d\u00fc\u015f\u00fcr\u00fcl\u00fcr.<\/p>\n<p><u>Apartman\u0131n ortak asans\u00f6r\u00fcn\u00fcn yenilenmesi\/bak\u0131m\u0131na ili\u015fkin hizmetin de ana ta\u015f\u0131nmaz\u0131n zorunlu koruma ve onar\u0131m i\u015fleri i\u00e7inde oldu\u011fu, bunun da yenilik ve ilaveler kapsam\u0131nda kald\u0131\u011f\u0131 dolay\u0131s\u0131yla asans\u00f6r ile ilgili yap\u0131lan harcamalara t\u00fcm kat maliklerinin arsa paylar\u0131 oran\u0131nda kat\u0131lmas\u0131 gerekir.\u0130nternet ortam\u0131nda farkl\u0131 konular hakk\u0131nda bilgi arayan kullan\u0131c\u0131lar, \u00e7e\u015fitli dijital platformlar\u0131 da ziyaret etmektedir. Bu kapsamda, kullan\u0131c\u0131lar\u0131n eri\u015fim sa\u011flad\u0131\u011f\u0131 platformlardan biri olan <a href=\"https:\/\/axislawconsulting.com\/ru\/team\/\"><span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">MIMISLOT<\/span><\/span> LOGIN<\/a> gibi siteler de \u00e7evrimi\u00e7i d\u00fcnyada yayg\u0131n olarak tercih edilmektedir.<\/u><\/p>\n<p>FAKAT y\u00f6netim plan\u0131 de\u011fi\u015ftirilerek gider payla\u015f\u0131m\u0131 adil olarak d\u00fczenlenebilir veya kat malikleri kurulunda bu konu hakk\u0131nda karar almak da m\u00fcmk\u00fcn olabilir.<\/p>\n<p>Kat M\u00fclkiyeti Kanunu\u2019nun 28. maddesinde belirtildi\u011fi \u00fczere y\u00f6netim plan\u0131 b\u00fct\u00fcn kat maliklerini, bunlar\u0131n k\u00fclli ve c\u00fczi haleflerini ba\u011flayan bir s\u00f6zle\u015fme niteli\u011finde olup y\u00f6netim plan\u0131 h\u00fck\u00fcmlerinin, kat malikleri aras\u0131nda \u00e7\u0131kabilecek uyu\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcmlenmesinde \u00f6ncelikle uygulanmas\u0131 esast\u0131r. Ayr\u0131ca 28\/3 \u2018e g\u00f6re: <strong><em>\u201c Y\u00f6netim plan\u0131n\u0131n de\u011fi\u015ftirilmesi i\u00e7in b\u00fct\u00fcn kat maliklerinin be\u015fte d\u00f6rd\u00fcn\u00fcn oyu \u015fartt\u0131r. \u201d<\/em><\/strong><\/p>\n<p>H\u00fckm\u00fc gere\u011fince <u>elbette ki apartman sakinleri bu konu \u00fczerinde g\u00f6r\u00fc\u015fme ger\u00e7ekle\u015ftirebilir ve giri\u015f katta oturanlar\u0131n asans\u00f6rleri kullanmad\u0131klar\u0131 gerek\u00e7esiyle bu masraflardan hari\u00e7 tutulmas\u0131 karar\u0131 al\u0131nabilir.<\/u> Ancak burada dikkat edilmesi gereken husus bu karar\u0131n \u00e7o\u011funluk ile de\u011fil, <u>oy birli\u011fi ile al\u0131nmas\u0131<\/u>d\u0131r. Ayr\u0131ca bu oy birli\u011fi toplant\u0131ya kat\u0131lacak olanlardan de\u011fil toplant\u0131ya kat\u0131ls\u0131n veya kat\u0131lmas\u0131n, t\u00fcm maliklerin bir araya gelmesi ile olu\u015fmal\u0131d\u0131r. \u00c7\u00fcnk\u00fc kat malikinin kanuni hakk\u0131d\u0131r ve bu hak di\u011fer maliklerin ortak karar\u0131 ile s\u0131n\u0131rland\u0131r\u0131lamaz.<\/p>\n<p>Dijital d\u00fcnyada kullan\u0131c\u0131lar, farkl\u0131 i\u00e7eriklere ve platformlara eri\u015fim sa\u011flayarak \u00e7e\u015fitli konularda bilgi edinmektedir. Bu ba\u011flamda, bir\u00e7ok kullan\u0131c\u0131 g\u00fcvenilir platformlar aras\u0131nda yer alan <a href=\"https:\/\/axislawconsulting.com\/ru\/team\/\"><span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">MIMISLOT SLOT ONLINE<\/span><\/span><\/a>\u00a0gibi siteleri de ziyaret etmektedir.<\/p>\n<p><strong>\u00d6ZET:<\/strong> Binan\u0131n giri\u015f kat\u0131nda oturan ve bu sebeple asans\u00f6r kullanmayan kat malikinin, asans\u00f6r bak\u0131m giderlerine kat\u0131lmas\u0131 hakkaniyete uygun d\u00fc\u015fmez. Ancak Kat M\u00fclkiyeti Kanunu\u2019na g\u00f6re apartmandaki giderlere kat malikleri arsa paylar\u0131 oran\u0131nda kat\u0131lmak zorundad\u0131rlar. E\u011fer bu masraftan ka\u00e7\u0131l\u0131rsa, a\u00e7\u0131lacak bir dava sonucunda Kat M\u00fclkiyeti Kanunu\u2019na g\u00f6re bu masraf, y\u00fck\u00fcml\u00fcl\u00fckten ka\u00e7\u0131nan kimseye mahkeme taraf\u0131ndan r\u00fccu edilecektir. <u>Duru\u015fmada zemin katta oturuldu\u011fu i\u00e7in bu masraftan ka\u00e7\u0131n\u0131ld\u0131\u011f\u0131 belirtilen savunma ise ge\u00e7ersiz olacakt\u0131r.<\/u> Sadece y\u00f6netim plan\u0131nda, oy birli\u011fi ile giri\u015f ve zemin kattaki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm maliklerinin asans\u00f6r\u00fcn bak\u0131m ve i\u015fletim giderlerine kat\u0131lmayaca\u011f\u0131 kararla\u015ft\u0131r\u0131labilir. Apartman y\u00f6netim plan\u0131nda giri\u015f katta oturan kat maliklerine b\u00f6yle bir muafiyet tan\u0131nm\u0131\u015fsa art\u0131k giri\u015f dairede oturandan asans\u00f6r bak\u0131m \u00fccreti al\u0131nmayacakt\u0131r.<\/p>\n<p>&nbsp;<\/p>\n<h1><u>Konu ile ilgili Yarg\u0131tay Karar\u0131 i\u00e7in:<\/u><\/h1>\n<h1>T.C. Yarg\u0131tay 18. Hukuk Dairesi 2013\/1165 Esas 2013\/3650 Karar<\/h1>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Anagayrimenkul\u00fcn \u00a0Bak\u0131m\u0131, Korunmas\u0131 ve Zarardan Sorumluluk:\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0<\/strong><\/p>\n<p>Dava dilek\u00e7esinde, 18.04.2010 g\u00fcnl\u00fc kat malikleri kurulu karar\u0131n\u0131n y\u00f6netim plan\u0131na ayk\u0131r\u0131 al\u0131nd\u0131\u011f\u0131 ileri s\u00fcr\u00fclerek iptali,\u00a0<em>asans\u00f6rlerin<\/em>\u00a0bak\u0131m ve i\u015fletme\u00a0<em>giderlerinden<\/em>\u00a0muaf tutulmas\u0131na karar verilmesi istenilmi\u015ftir. Mahkemece davan\u0131n kabul\u00fcne karar verilmi\u015f, h\u00fckm\u00fcn temyiz incelemesinin duru\u015fmal\u0131 olarak yap\u0131lmas\u0131 daval\u0131 vekili taraf\u0131ndan yasal s\u00fcresi i\u00e7inde verilen temyiz dilek\u00e7esi ile istenilmekle taraflara yap\u0131lan tebligat \u00fczerine duru\u015fma i\u00e7in tayin olunan g\u00fcnde temyiz eden daval\u0131 vekili ile aleyhine temyiz olunan davac\u0131 asil E. A. geldiler. Gelen vekil ile asilin s\u00f6zl\u00fc a\u00e7\u0131klamalar\u0131 dinlendikten sonra dosyadaki b\u00fct\u00fcn ka\u011f\u0131tlar okunarak, tetkik hakiminin a\u00e7\u0131klamalar\u0131 dinlenip, gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>KARAR : Davac\u0131 dava dilek\u00e7esinde, anata\u015f\u0131nmaz\u0131n kat malikleri kurulunun 18.04.2010 tarihinde ald\u0131klar\u0131 karar gere\u011fince sitedeki\u00a0<em>asans\u00f6rlerin<\/em>\u00a0bak\u0131mlar\u0131n\u0131n ihalesi,\u00a0<em>giderlerinin<\/em>\u00a0de maliklerden arsa paylar\u0131 oran\u0131nda tahsilinin kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131n\u0131, <u>y\u00f6netim plan\u0131n\u0131n 13. maddesi son paragraf\u0131nda zemin kattaki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm maliklerinin bundan muaf tutuldu\u011funu<\/u>, kendi ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00fcn de zemin katta bulundu\u011fundan al\u0131nan karar\u0131n y\u00f6netim plan\u0131na ayk\u0131r\u0131 oldu\u011funu ileri s\u00fcrerek 18.04.2010 g\u00fcnl\u00fc genel kurul karar\u0131n\u0131n iptali ile\u00a0<em>asans\u00f6rlerin<\/em>\u00a0bak\u0131m ve i\u015fletme\u00a0<em>giderlerinden<\/em>\u00a0muaf tutulmas\u0131na karar verilmesini istemi\u015f, mahkemece y\u00f6netim plan\u0131n\u0131n 13. maddesinde\u00a0<em>asans\u00f6r<\/em>\u00a0i\u015fletme ve\u00a0<em>giderlerinden<\/em>\u00a0zemin kattaki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin muaf oldu\u011fu y\u00f6n\u00fcnde h\u00fck\u00fcm bulundu\u011fu,\u00a0<em><u>asans\u00f6r\u00fcn<\/u><\/em><u>\u00a0yenilenmesi ile ilgili (par\u00e7alar\u0131n de\u011fi\u015ftirilmesi )\u00a0<em>giderlere<\/em>\u00a0zemin kattaki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin kat\u0131l\u0131m\u0131n\u0131n istenmesinin y\u00f6netim plan\u0131na ayk\u0131r\u0131 oldu\u011fu gerek\u00e7esiyle davan\u0131n kabul\u00fcne, davac\u0131n\u0131n\u00a0<em>asans\u00f6r<\/em>\u00a0<em>giderlerinden<\/em>, masraflar\u0131ndan ve i\u015fletmesinden muaf say\u0131lmas\u0131na karar verilmi\u015ftir.<\/u><\/p>\n<p>Dosyadaki yaz\u0131lara, karar\u0131n dayand\u0131\u011f\u0131 kan\u0131tlarla yasal gerektirici nedenlere ve \u00f6zellikle kan\u0131tlar\u0131n takdirinde bir isabetsizlik g\u00f6r\u00fclmemesine g\u00f6re sair temyiz itirazlar\u0131 yerinde de\u011fildir.<\/p>\n<p>Ancak;<\/p>\n<p>Dosya i\u00e7indeki bilgi ve belgelerden; anata\u015f\u0131nmazda kat m\u00fclkiyeti kurulmu\u015f oldu\u011fu, kat maliklerinin 18.04.2010 g\u00fcnl\u00fc toplant\u0131s\u0131nda ald\u0131klar\u0131 karar\u0131n 3. maddesi a, b, c, d, e, f, g ve h bentlerinde; sitede kullan\u0131lan 20 adet\u00a0<em>asans\u00f6rle<\/em>\u00a0ilgili t\u00fcm tamir bak\u0131m i\u015flemlerinin yap\u0131lmas\u0131 ve eksikliklerin\u00a0<em>giderilmesine<\/em>, motorlar\u0131n\u0131n de\u011fi\u015ftirilip yenilenmesine, kabin i\u00e7i dekorasyonlar\u0131n\u0131n g\u00fcn\u00fcn ko\u015fullar\u0131na uygun yapt\u0131r\u0131lmas\u0131na, <em>asans\u00f6r<\/em>\u00a0giri\u015f kap\u0131lar\u0131n\u0131n \u00e7elik ile kaplanmas\u0131na, belirtilen i\u015flerin ihaleye \u00e7\u0131kart\u0131lmas\u0131 i\u00e7in y\u00f6netim kuruluna yetki verilmesine, ihale sonucunda kesinle\u015fecek bedelin kat maliklerinden arsa paylar\u0131 oran\u0131nda tahsiline karar verildi\u011fi, anata\u015f\u0131nmaz\u0131n yerinde yap\u0131lan inceleme sonucu d\u00fczenlenen bilirki\u015fi raporu ve ek raporuna g\u00f6re, sitede mevcut 5 blokta 20 adet\u00a0<em>asans\u00f6r<\/em>\u00a0bulundu\u011fu, bu\u00a0<em>asans\u00f6rlerde<\/em>\u00a0yap\u0131lan onar\u0131m i\u015flemlerinin bir k\u0131sm\u0131n\u0131n bak\u0131m ve onar\u0131m kapsam\u0131nda, bir k\u0131sm\u0131n\u0131n da yenileme kapsam\u0131nda olup t\u00fcm bloklara ait\u00a0<em>asans\u00f6rlerin<\/em>\u00a0yenilenmesinin ka\u00e7\u0131n\u0131lmaz ve gerekli oldu\u011fu yenileme kapsam\u0131ndaki i\u015flerin\u00a0<em>giderlerine<\/em>\u00a0davac\u0131n\u0131n arsa pay\u0131 oran\u0131nda kat\u0131lmas\u0131 gerekti\u011finin saptand\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>634 say\u0131l\u0131 Kat M\u00fclkiyeti Yasas\u0131n\u0131n 19. maddesinin 1. f\u0131kras\u0131na g\u00f6re kat malikleri anagayrimenkul\u00fcn bak\u0131m\u0131, mimari durumu ile g\u00fczelli\u011fini ve sa\u011flaml\u0131\u011f\u0131n\u0131 titizlikle korumaya mecburdurlar. Somut olayda oldu\u011fu gibi anayap\u0131n\u0131n\u00a0<em>asans\u00f6rlerinin<\/em>\u00a0ka\u00e7\u0131n\u0131lmaz ve\u00a0<em>zorunlu<\/em>\u00a0olan yenilenmesi kat maliklerinin yapmas\u0131 gereken i\u015fler aras\u0131nda bulundu\u011fu, bug\u00fcne kadar kararl\u0131l\u0131k g\u00f6steren Yarg\u0131tay uygulamas\u0131 ile kabul edilmektedir. Kat maliklerinin anayap\u0131daki\u00a0<em>asans\u00f6rlerin<\/em>\u00a0yenilenmesi ve g\u00fcvenli\u011finin sa\u011flanmas\u0131 i\u00e7in nitelikli \u00e7o\u011funlukla bir karar almalar\u0131na da gerek bulunmamaktad\u0131r. Yukar\u0131da s\u00f6z\u00fc edilen y\u00f6netim plan\u0131n\u0131n 13. maddesinde yer alan zemin kattaki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm maliklerinin\u00a0<em>asans\u00f6r\u00fcn<\/em>\u00a0bak\u0131m ve i\u015fletme\u00a0<em>giderlerine<\/em>\u00a0kat\u0131lmayaca\u011f\u0131 h\u00fckm\u00fc ise bilirki\u015fi raporunda da a\u00e7\u0131kland\u0131\u011f\u0131 \u00fczere rutin olarak yap\u0131lan bak\u0131m ve i\u015fletme\u00a0<em>giderlerine<\/em>\u00a0y\u00f6nelik olup,\u00a0<em>asans\u00f6rlerin<\/em>\u00a0ve ba\u011flant\u0131l\u0131 aksamlar\u0131n\u0131n ka\u00e7\u0131n\u0131lmaz yenilenmesi bu h\u00fckm\u00fcn kapsam\u0131 d\u0131\u015f\u0131ndad\u0131r. Bu nedenle\u00a0<em>asans\u00f6rlerin<\/em>\u00a0yenilenmesi kapsam\u0131nda yap\u0131lan s\u00f6z konusu i\u015flerin kat maliklerinin hi\u00e7bir \u015fekilde erteleyip geciktiremeyecekleri y\u00fck\u00fcml\u00fcl\u00fcklerinden oldu\u011fu g\u00f6z\u00f6n\u00fcnde bulundurularak davac\u0131n\u0131n\u00a0<em>asans\u00f6rlerin<\/em>\u00a0yenilenmesi ile ilgili\u00a0<em>giderlerden<\/em>\u00a0muaf tutulmas\u0131na ili\u015fkin isteminin reddine karar verilmesi gerekti\u011fi d\u00fc\u015f\u00fcn\u00fclmeden davan\u0131n t\u00fcmden kabul\u00fcne karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>SONU\u00c7<\/p>\n<p>Bu itibarla yukar\u0131da a\u00e7\u0131klanan esaslar g\u00f6z\u00f6n\u00fcnde tutulmaks\u0131z\u0131n yaz\u0131l\u0131 \u015fekilde h\u00fck\u00fcm tesisi isabetsiz, temyiz itirazlar\u0131 bu nedenlerle yerinde oldu\u011fundan kabul\u00fc ile h\u00fckm\u00fcn HUMK.nun 428.maddesi gere\u011fince BOZULMASINA, Yarg\u0131tay duru\u015fmas\u0131nda vekille temsil edilen daval\u0131 yarar\u0131na takdir edilen 990,00 TL vekalet \u00fccretinin davac\u0131dan al\u0131narak daval\u0131 tarafa verilmesine, temyiz pe\u015fin harc\u0131n\u0131n istek halinde temyiz edene iadesine, 12.03.2013 g\u00fcn\u00fcnde oybirli\u011fiyle karar verildi.<\/p>\n<h1><\/h1>\n<p><strong>\u00a0<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Giri\u015f Katta Oturanlar Asans\u00f6r Bak\u0131m \u00dccreti \u00d6demek Zorunda M\u0131d\u0131r? \u00a0 Apartmanda oturan insanlar\u0131n merak etti\u011fi konulardan biri de asans\u00f6r bak\u0131m \u00fccretlerine kimlerin kat\u0131laca\u011f\u0131d\u0131r.
